Just Compensation — Remainder Damages in Partial Taking Cases

Property owners who lose a portion of their land in condemnation proceedings no longer have to endure the paradox of finding themselves worse off than if the entire parcel had been taken. Thanks to a trend pioneered by the federal court system, determination of just compensation in partial taking cases has been liberalized.
